By accessing or using SmilePath ("the Service"), operated at smilepath.ai, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use the Service.

Informational purposes only

SmilePath provides informational content about dental and orthodontic treatments for educational purposes only. Nothing on this platform constitutes medical or dental advice, diagnosis, or treatment. The AI-powered smile analysis, treatment recommendations, and visualizations are tools to help you explore options — they are not a substitute for professional consultation. Always consult a licensed dentist or orthodontist before making decisions about your dental care.

No guarantees

We make no guarantees regarding the accuracy of AI-generated analyses, treatment recommendations, or result visualizations. Treatment outcomes vary significantly based on individual oral health, medical history, provider skill, and other factors. The information presented on SmilePath — including pricing estimates, recovery timelines, and effectiveness ratings — represents general ranges and should not be relied upon as precise predictions for your specific situation.

Provider relationships

SmilePath connects users with dentists and orthodontists. We do not employ, endorse, or guarantee any provider listed on the platform. We are not a party to any agreement between you and a provider. Provider listings may include both SmilePath member practices (providers who have claimed their profiles) and non-member providers sourced from public directories. The inclusion of a provider on SmilePath does not constitute a recommendation or endorsement of their services.

Clinic memberships

Dental and orthodontic practices may purchase a SmilePath membership, billed as a recurring monthly subscription through our payment processor, Stripe. Membership includes priority placement in patient search results and direct delivery of patient inquiries. Memberships may be canceled at any time; cancellation stops future billing and ends member benefits at the close of the current billing period. Fees already paid are non-refundable except where required by law.

User conduct

By using SmilePath, you agree not to:

• Use the Service for any unlawful purpose
• Submit false or misleading information
• Attempt to access another user's data or account
• Interfere with or disrupt the Service's infrastructure
• Scrape, data-mine, or extract content from the platform in bulk
• Use the Service to harass or send unsolicited messages to providers

Intellectual property

All content on SmilePath — including text, graphics, logos, treatment descriptions, UI design, and software — is the property of SmilePath or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.

Limitation of liability

To the fullest extent permitted by applicable law, SmilePath and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes, but is not limited to, damages arising from: treatment decisions made based on information found on the platform, provider interactions facilitated through the platform, or the accuracy of AI analyses and recommendations. Our total liability shall not exceed the amount you paid to use the Service in the twelve months preceding the claim.

Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

Indemnification

You agree to indemnify and hold harmless SmilePath and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

Modifications

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "last updated" date. Continued use of the Service after changes constitutes acceptance of the revised terms.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
